  • Trips and Tips for Negotiation Self-Defense: Forewarned is Forearmed

Continued attention in both the popular and academic press regarding negotiation and the related concepts of influence and persuasion is nothing short of astonishing. The topics on which we focus in this article, however, are rarely-if ever-vetted in such outlets. We venture, with some measure of caution, into the dark side of negotiation: those tactics that may be duplicitous, unethical, and unprincipled. Such tactics provide a quintessential moral hazard, as they are both brutally effective and rarely illegal. It is not our intent to provide a treatise on unsuitable behavior. Rather, our objective is to establish that no one need be victimized by such behaviors, as all of these tactics are avoidable. It is in this spirit that we provide some guidelines on self-defense in a negotiation context to avert and attenuate the consequences of these behaviors.

  • Reed--YPEC Negotiation: Reed Oilwell (A)

This negotiation introduces a situation full of opportunities for hard bargaining and out-of-the-box thinking about value-creating solutions. The American supplier Reed Oilwell views this business opportunity as a side door into the Petroecuador supplier network. The cross-cultural elements of the relationship are important, especially in the context of the various political aspects that shape the relationship between YPEC and its major customer, Petroecuador. The negotiation illustrates the potential for a cooperative approach but also offers the opportunity for a competitive outcome. The parties are instructed to reach a deal that satisfies their short-term goals, but their decisions will impact their ability to establish a preferred supply position in the new oil field operations.

  • Everything or Nothing: Martti Ahtisaari and the Aceh Negotiations (A)

In early 2005, Martti Ahtisaari planned negotiations to end the decades-long conflict between Acehnese insurgents and the Indonesian government that had claimed thousands of lives. The "modern" phase of the insurgency by the fighters from the Free Aceh Movement that sought independence from Indonesia had persisted for some 30 years, claiming tens of thousands dead, countless wounded and tortured, as well as economic damage estimated by the World Bank at over $11 billion. In a few short days, Ahtisaari, former Finnish President and longtime diplomat active in some of the world's nastiest trouble spots, would see if he and his team could help foster an elusive accord between the bitter, distrustful parties to the conflict.

  • Esquel Group: Building a Sustainable Partnership with Cotton Farmers in Xinjiang (A)

Esquel Group, leading manufacturer of quality shirts, sought to negotiate long-term partnerships with often-exploited farmers in Xinjiang (western China) to procure a superior cotton variety. Seeking to secure a large supply of specialty cotton in an ethical and socially responsible fashion, Esquel undertook a major 2002 initiative to negotiate value-creating contracts among itself, local Xinjiang municipal governments, and cotton farmers. Aware that contract enforcement in China can be challenging, Esquel offered the region's poor, often-suspicious farmers attractive advanced financing, guaranteed minimum pricing, and other generous terms in return for an agreement to sell their crop exclusively to Esquel. The case concludes with the specialty cotton harvest shaping up as very good while demand for the premium cotton fiber appears to be stronger than ever.

  • Extreme Negotiations

CEOs and other senior executives these days must manage countless complex, high-stakes conversations across functional areas and divisions, with alliance partners and critical suppliers, and with customers and regulators. The pressure of such negotiations make them a lot like U.S. military officers in an Afghan village, fending off enemy fire while trying to win trust and intelligence from the local populace. Both kinds of leaders face what the authors call "dangerous negotiations," in which the traps are many and good advice is scarce. Although the sources of danger are quite different for executives and officers, they resort to the same kinds of behaviors. Both feel pressure to make quick progress, project strength and control (particularly when they have neither), rely on force rather than collaboration, trade resources for cooperation rather than build trust, and make unwanted compromises to minimize potential damage. The authors outline five core strategies that "in extremis" military negotiators use to resolve conflicts and influence others: maintaining a big-picture perspective; uncovering hidden agendas to encourage collaboration; using facts and fairness to get buy-in rather than grudging support; building trust; and focusing on process as well as outcomes. These strategies provide an effective framework with which business negotiators can change their thinking ahead of the deal as well as their actions at the bargaining table.

The buyer is planning to start his own saltwater fishing business in the Florida area.
