• Google: Antitrust Battles in India

In addition to Google, LLC (Google) facing multiple litigations around the globe, India’s antitrust watchdog, the Competition Commission of India (CCI), had recently launched its own investigation into the company. This was not the first occasion of an antitrust probe being initiated against Google in international markets. The company had already paid an astonishing US$ 9 billion in fines for abusing Android’s dominant position in the smartphone market to boost its dominance in other areas, such as web searching, browsing, and mobile apps. In 2019, Google was in trouble in India, again, for similar reasons. The CCI alleged that Google forced smartphone manufacturers to pre-install Google Search and the Google Chrome browser on their devices, thus misusing its dominant position by stopping smartphone manufacturers from opting for alternative versions of its mobile operating system (OS). However, Google strongly denied these allegations, arguing that it had not indulged in anti-competitive practices; rather, it claimed it had promoted relevant market competition.

Which marketing practices of Google invited the antitrust probe and allegations of abuse of their dominant position in India? Why were competition watchdogs concerned about the growing dominance of Google in the Indian mobile operating software (OS) market? In an oligopolistic market comprising multiple players, why did the CCI consider Google to be a dominant player in the Indian mobile OS market? Could Google do something to avoid antitrust lawsuits and allegations of abuse of dominance in the future?

  • The Qingdao International Beer Festival

Holding a massive beer festival brought the Chinese city of Qingdao and Tsingtao Beer Co. Ltd., China’s most famous beer brand, direct economic benefits and public awareness. However, through the Qingdao International Beer Festival—a natural advertising opportunity—foreign beers benefited as well. To date, Chinese beer brands held less than half of the high-end Chinese beer market. China levied no tariffs on beer imports, which increased the market competition. Were the objectives of Tsingtao Beer and the local government fully aligned with regard to the annual festival? Was the beer festival helping one more than it helped the other? Did it help Tsingtao Beer’s competitors? Should the Qingdao International Beer Festival work to recapture or emphasize some of its own cultural uniqueness?

  • Basmati House Supermart: Co-Operative Competition with an E-Retail Channel

In July 2019, the owner of Basmati House Supermart (BHS), a grocery store, entered into a six-month agreement to become a partner outlet of a large online grocery retailer in India. During the first two months, BHS acquired many new customers and also increased its customers’ monthly purchase. However, the steep discounts and promotions used to attract customers to the business drove down the margins, while the customer churn rate increased. The store owner was particularly concerned about the continued use of discounts to attract new consumers, which could potentially transform his own loyal customer base into deal-seeking, less loyal, and online-promotion-driven buyers, thereby leaving BHS terminally dependent on the large online retailer to maintain its sales. The owner wondered whether he should renew his contract with the online retailer in January 2020, and if he did not, what his best course of action would be.

  • Þorvaldur Danielsson: At a Crossroads as a Social Entrepreneur

In late 2018, a social entrepreneur in Iceland realized he needed to make changes to his enterprise working with socially-isolated children and youth. His operating model was to host bicycle rides with children and youth, and to encourage them to engage fully as young people. Most of these children had not previously engaged in physical activity, and many experienced not only social difficulties, but also physical challenges as a result of being overweight or obese. The social entrepreneur was spending much of his time negotiating sponsorship and service agreements and as a result, he spent less time engaging with the focus of his initiative—at-risk children and youth. He was also funding some of the initiative himself, putting his personal financial circumstances at risk. How could this social entrepreneur develop a robust, sustainable business model that would enable him to develop financial independence, support the youths' involvement in an annual cycling ride that circumnavigated Iceland, and enable the business to expand so that it no longer relied totally on one person?

  • Tata Consultancy Services Limited: The Joint Venture with Mitsubishi Corporation in Japan

In June 2019, Tata Consultancy Services Limited (TCS), a leading Indian global information technology (IT) services, consulting, and business solutions provider, announced that it would increase its shareholding in Tata Consultancy Services Japan Limited (TCS Japan) from 51 per cent to 66 per cent. Established in July 2014, TCS Japan was a joint venture between TCS and Mitsubishi Corporation (MC), one of Japan’s largest integrated business enterprises. This collaboration was not TCS’s first foray into Japan’s IT industry; the company had entered the Japanese market in 1987, but with a wholly owned subsidiary. Why did TCS give up a part of its full ownership and control to MC in 2014? Was such an alliance a merger of equals or more a sale of the Japanese branch to a stronger local suitor? Why did the company reclaim its ownership in 2019 through an increase in equity holding? To penetrate the Japanese IT services market and compete with local giants, should TCS have acquired another medium-sized Japanese company instead of joint venturing with MC? Or, should it have continued operating in the Japanese market alone through the wholly owned subsidiary?

  • A Note on China’s Approach to Cryptocurrency and Blockchain Application in the Games Industry: Coco Game Currency

An estimated 640 million online gamers participated in China’s games industry in 2019. Their pursuit included earning points or tokens that they could redeem for prizes or gifts and in-game assets. A centralized platform allowed game operators to share the administration and management of tokens and rewards, but the system was not as transparent or immutable as stakeholders desired. In January 2019, a new points redemption system was launched based on blockchain technology. The new system, involving game operators, users, custodian banks, suppliers, and tax agents was credible and more transparent, and foreshadowed China’s growing interest in legal digital currency. How policy would shift toward digital currency was unclear; however, the fact that the blockchain race between countries had intensified was clear. The application of blockchain in China’s games industry was just one of the visible examples.
