  • Negotiating from the Margins: The Santa Clara Pueblo Seeks Key Ancestral Lands Sequel

This negotiations case describes the approach, over time, of Santa Clara, a small Pueblo Indian tribe in New Mexico, to recover a piece of land tribal leaders viewed as integral to their ancestral homeland. Unlike many negotiations cases, which concern the strategizing of two or more powerful players, this case describes the evolving strategy of a small, marginal player, striving mightily for a seat at a negotiating table dominated by several powerful interests. Initially taking a rights-based line of attack, the Santa Clara Pueblo eventually adopted a more strategic approach, seeking to understand the perspective of the U.S. Forest Service, the New Mexico Congressional delegation, and other important stakeholders, and to frame its arguments in a way the agency representatives and politicians would find most compelling. The case ends partway through the final, detailed negotiation between Santa Clara and the U.S. Forest Service, when a tense standoff arose. At this juncture, Santa Clara faced a difficult choice-whether to accept a partial win, to walk away, or to fight for more and perhaps risk losing all. A brief sequel describes what Santa Clara did, what the U.S. Forest Service did, and the resolution ultimately embraced by both sides.Case number 2021.1

She knew that the budget for this year projected a loss, so she decided to better understand the financial problem first.

  • Houston, We Have a Solution: NASA and Open Innovation (B)

Jeff Davis, director of Space Life Sciences Directorate at NASA, has been working for several years to raise awareness amongst scientists and researchers in his organizations of the benefits of open innovation as a successful and efficient way to collaborate on difficult research problems regarding health and space travel. • Driving Innovation at PAR Springer-Miller (B)

In fall 2009, the new president and chief executive officer of PAR Springer-Miller Systems, based in Stowe, Vermont, is tasked with leading the most significant innovation effort the company has undertaken since its founding in 1984. The company is a leading provider of property management, point-of-sale and spa management systems for high-end hotels, resorts, spas and casinos worldwide, but its legacy products are based on outdated technology and subject to increasing customer complaints; at the same time, the global recession has negatively affected the high-end market. In his first year, the new president has made significant progress in restructuring the organization and shifting its culture to a more entrepreneurial one. He is ready to begin the development of an entirely new product but has to decide on strategy, in particular deciding on the best market on which to focus the new software product and then mapping out a plan to execute its development and launch. How can he elicit a radical innovation from a team of management and employees so culturally rooted in their past accomplishments and legacy products? Should he look for a technology partner and develop the new product in a different location? Can the legacy products be kept up and running long enough for the new product to generate sufficient sales that they can be retired? These are the issues that must be addressed or the company may well face a dire future. See A Case 9B14C022.

  • Hillside Hospital: Physician-Led Planning (Part B)

Dr. John Niff, co-chair of the Medical Advisory Panel (MAP) to Hillside Hospital, waited for his colleagues to join him to review the recommendations for The New Hillside Hospital that the panel had developed over the past six months. When Bill Hurst, Hillside's CEO, had first suggested creating a committee of doctors (the MAP) to develop recommendations for clinical programs at the hospital, Niff was skeptical. But as the clinicians worked together to identify problems and set priorities, they developed their management skills as well as a greater appreciation for the challenges facing the hospital. Trust between management and physicians grew as the hospital implemented some of the panel's recommendations. Although the MAP's list of recommendations had not yet been formally accepted by the Board, all participants reflected on the benefits already gained through this process.

  • Retail Relay (C)

This short case serves as an epilogue to the A and B cases. Specializing in local organic meat and produce, Retail Relay has developed a new business model for online grocery shopping and delivery. Relay could tell from its customer-level purchase data that many of its existing customers were purchasing some of their grocery products from other vendors. Relay therefore developed a heuristic to categorize customers as active or churned. They then explore how to use customer-level purchase information to determine factors that distinguish between active and churned customers.
