遠雄大巨蛋BOT爭議及促參永續推動:當公共利益遇上商業利益
台北大巨蛋(台北文化體育園區)是促進民間參與公共建設(BOT)的指標性開發案,歷經數十年選地、招標、議約後,開工後的興建過程卻一再延宕,台北市政府與得標廠商遠雄企業集團間出現眾多關於零權利金、契約條文、公安、環評、古蹟保存等等爭議,這些爭議問題同時也是台灣推動促進民間參與公共建設法、BOT困境的折射,由於此案牽涉範圍相當大與複雜,且本文並非要探究台北市府與遠雄企業誰是誰非,目的僅在藉由推動過程中產生的爭議,從公共利益與商業利益權衡的角度,對促進民間參與公共建設「計畫效益」議題進行教學與討論。
